Can I transfer my data from one iPhone to another without upgrading iOS?

I currently have a iPhone 4S and am having trouble with it, I'm going to the Apple store to get another iPhone 4S but I want to make sure that I keep the same iOS I have now (YouTube app and Google Maps). If the new iPhone comes with a higher iOS will my phone downgrade or be forced to upgrade?

If you get a new iPhone you can be sure it will have the latest iOS.
