If it has not been reported as stolen or lost then it would be able to connect. As long as you actually found it and didn't steal it you should be in the clear.

(If you "found it" the most honest thing is return it to any of the phone carrier's store)

With that being said. You can activate the phone if its a GSM phone (phone that uses sim card). CDMA phones (phones that don't use sim card) get locked by carrier if its reported stolen, lost, or if the person didn't pay the bill and got disconnected. The will not activate the phone for anything.

So it all depends what company the phone is from. GSM ( at&t/tmobile/etc) can activate it. CDMA (Sprint/Verizon/Etc) won't.

You should keep in mind that a phone provider is not a police office, they will not take it away from you. If you found the phone, and you do not wish to return it, you should restore the phone, and destroy any sim card inside the device, as it would make tracking your location impossible, and you won't have police officers show up at your door when the owner tracks his or her phone to you!

I'm not telling you what you should do, but you should know phone companies can't take phones from you.
