It depends on what kind of warranty you have.
Neither, unfortunately AT&T doesn't provide insurance for lost or stolen phones… Until its reported stolen you are on the hook for charges so you should call and report it. As for a new iPhone if your contract isn't up for renewal you will be out of pocket full price for a new one.
You have to pay a fee for a replacement ASSUMING YOU PAY THE MONTHLY FEE FOR INSURANCE (probably about $100 for an iphone 5) and they'll send you a refurb one.also, if you activate your old one, it'll be marked as stolen and the user will get into trouble, probably a fine.
Well they aren't just handing you a new phone for free because you lost yours. They aren't stupid.
If its under warranty you will pay $149 and get a referbished iphone 5 and the lost iphone will be blacklisted making it useless as a phone on and carrier.
