Is this legal? Would you like to WIN an Iphone scam site?

I came across a site and it is clearly a scam on the website it says "would you like to WIN an iPhone 5?" and then they do not actually have the means to give you an iPhone but they still ask a lot of details such as your Facebook username and password, your telephone number, your address and much more information about you.

It also says "if you are on Facebook you may own an iPhone soon!"

I know this kind of site can be so annoying and frustrating to many people but are they actually breaking the law or not?! Because they are not actually saying "you have the chance of winning an iPhone" or "we will give you an I phone!" they just said "would you like to win an iPhone and if you would then please submit us your details below".

I know the idea is probably to make people think that if they feel in this form that they will be entered into a prize draw but they actually aren't!

I read the Terms and Conditions and it said in it:

By submitting your personal information in the form on this site you understand that:

1. You understand that we will not be giving you an iPhone or anything else.
2.By submitting your details the form on our site you give us permission to access your Facebook by using your username and password.
3. You are happy for us to know your personal details that you have sent to us using the form on the site and you are happy to share that information with us and we can use that information for any purpose and share it with other people or/and agencies/companies/charities etc… Or to anything and anyone.

When I read the Terms and Conditions after I clicked on the Terms and conditions I was half angry and half laughing! Because you have to click to see the Terms and Conditions and what makes me angry is that most people WILL NOT bother looking at the Terms and Conditions. So another one of my questions is that if they have a Terms and Conditions link on the site with the above terms and conditions written there but they DO NOT have the terms and conditions on the home page of the site, is this still legal?

Can the person/owner of this site get into legal trouble because they haven't mentioned anywhere that they will actually give you an iPhone and they haven't actually said that anyone has a chance of getting one of them and the terms and conditions clearly states what they are going to do with this information that someone gives them via the website. Or is this site completely complying with the law?

There's also no do you agree with the terms and condition tick box, Do they need a tick box to say that they agree with the Terms and Conditions?

If I can I would like to report them, can I?

Second, it sounds legit to me. I won 15 iPhones on sites like this (so-called scams). I sold them on eBay and made likee $1300 last month.

You would have to be really stupid to give them your personal information. Having the site is not illegal, stealing your information so they can commit fraud and identity theft is a crime. But it sure isn't worth the risk of giving them information. Why did you even go to the site? YOu can get a virus just going to it.

They have covered all of the legal bases - people who agree or disagree have certainly been informed about what the site is about, what the "give away" means.

For that matter if you are on this site I might give you an iphone - but I might not.

Not much difference, except I'm not collecting and selling your data.
