Can you legally take a phone that has gone unclaimed?
I work in the reception area of an office building and manage the lost and found. About four months ago, someone found an Iphone 7 outside the door of the building and dropped it off. No one tried to call the phone. I saw there were a number of reminders for different meetings in the building, and I called several different departments to see if anyone had been missing a phone. No one has claimed it, and I was going to take it to the apple store to see if they can determine who it belongs to. If no one claims it, can I simply have it?
Added (1). I talked to my supervisor, and there's no official "company policy" regarding lost and found items. I was told to do what I think is best.
Take it to the cops… If it remains unclaimed in their possession for 90 days then you can claim it.
No you can't. It obviously belongs to someone. The phone carrier would be your best bet in finding the owner.
Talk to your supervisor about the company policy about un-claimed found property.
Not recommended. Take it to the police department.
That's a pretty big "if". Yes, you can "have" it, but… Does your company have a policy about this? You have to stick to that policy. Otherwise, you can have it… Until the real owner shows up and claims it. Which could be a year or two from now.
Generally, you have to make reasonable efforts to find the owner. Taking it to the Apple store is a good idea.
No you can't have it. Call the phone number if not locked and or turn it in to the police. The value of the phone could make you a criminal and your position of thinking that you get something for nothing will keep you poor forever.
Your company should have handed in to the Police.
If unclaimed from then often yiu can have it after a set period.
That is the definition of "theft". Taking property of another without their consent, with intent to keep it as your own. In my state, if the phone is worth over $250, that would be a felony. The ONLY thing you can do, beyond what you already tried for returning it, is take it to the police. They MIGHT have a policy that allows you to later reclaim the property, once it has become officially "abandoned". Some states require such property to be auctioned by the municipality after all unsuccessful attempts to find the rightful owners. Bottom line, it's not "yours" to take.

- When someone gives you something, is it yours legally? Basically, my (now ex) boyfriend gave me 2 phones while we were together. One was because i lost one my phones and the other one was a gift. He never mentioned that i would have to give either of them back if and when we broke up. But now we have he is demanding i give them back. He has a perfectly good working IPhone 4S. So do i have to give them back or are they legally mine? Because neither me or my dad have money to buy me a new phone at the moment.
