I just got a used iphone 5 and it has a pass code, I can't reach he person I got it from to get their apple id.
Is there a way to restore the phone without this?
No, its not stolen.
You would have to put your phone In recovery mode and connect it to iTunes via USB to restore it completely. If you don't feel comfortable doing that I would strongly recommend called Apple Support.
