I give my girlfriend a iPhone 6 as a present and I want it back?
I have my girlfriend a iPhone 6 as a gift last week and she said she wants to break up today, its basically mine because I bought and I have the receipt. So can I legally take it back or is it going to be theft?
Judge Judy says that if you give something as a gift, it then belongs to the recipient. You can't ask for it back.
There used to be a rule of etiquette that you didn't give anything expensive or personal to another person until you were engaged. That's a good rule to go by. Consider this a learning experience.
You can ask her to give it back however she has no legal obligation to do so. With few exceptions gifts once given are the property of the recipient and the giver has no rights to the item.
Spend your money and buy a new one.

Too bad, you gave it as a gift, it belongs to her. It's theft if you steal it.
Bit tricky here -- did you buy it outright or is it on contract?
if you bought it outright and gave it to her, it's hers. If there's a contract, then you probably only gave her the use of it while you pay -- stop paying and it's no longer either yours or hers but goes back to the supplier.
What part of gift is not clear.

My IPHONE had a defect, still under warranty, so I took it to an Apple MAC store and after a few days they gave it back, supposedly repaired. Now the replaced IPHONE has a problem, different than the previous problem I'm now having a problem with the taking a photo. Do they just replace your phone with a reconditioned one they say no but?

- I changed my mind on the present I want? Every year I get one main, more expensive present and then cheaper gifts. This year what I asked for was an iPhone 5C. It was kind of an impulse decision. Recently I've been looking at reviews and such of the new iPhones and I don't want the iPhone 5C, now I want the 5S.
