Sorry to tell you but no i don't think they can. If you have location services on and the phone isn't shut down than maybe they can.

You should of had to register for the "Find my iPhone" app when you first got your iPhone 4s. Go to iCloud.com and you should be able to track its location. On or Off. You can get the police involved, Apple advises that you do that if needed. And hopefully you don't have a simple pass-code.
BUT if you refused to let allow your iPhone 4s to send out its "Location" coordinates in your settings, then your iPhone won't be located.
- Lost my iPhone, can I track it? Is there any way to track it? It's an iPhone5 and I tried calling back from a different phone number it rings once and then it was going straight to voicemail. After hrs of calling and the same thing happening I called and now it goes straight to voicemail. I'm not sure if I misplaced it at home or I simply lost it running errands.

- Lost iPhone. Can't track it My buddy lost his iPhone 5 (but it may have been stolen). He has the "find my iPhone" app as well as the "find friends" app. The problem is he didn't register the "find my iPhone" and he has the find friends app turned to "hide me" mode. Is there any other way to track down his phone? He could lose his job over this… Can he activate any of these apps through iCloud? Any solutions would help.
