I sent an iPhone over Ebay and the buyer is saying they haven't received it?

Someone brought an iPhone of me on Ebay, we agreed on first class postage as they said it was okay.
It's been 10 days and she is telling me she never received the phone.
What do I do?
She said she will complain to Ebay, will they take the money out of my bank account without my consent? (I don't have any money in there) or what?
I definitely sent the phone.
I will Record Deliver everything next time but can I really get into any legal troubles over this?

They are trying to scam. But no they will not they have to do a deep investigation

No legal trouble but you may be out a phone

Unfortunately, that is one of the commonest scams. You are responsible for the delivery of the item to the buyer, both in ebay rules and in law.

Ebay will force a refund from your paypal account; paypal will eventually pass it to debt collectors if you do not return the money.

Make sure you use insurance on valuable items, eg. Special delivery not just Recorded. If something is damaged in transit you also lose out, unless you can claim on the insurance.

Do you still have the IMEI (serial number) of the phone? If so (or even if not…), you can tell the buyer that you will be reporting it stolen if it does not turn up. Say you will allow another week, in case it's been mis-routed in the post - it can happen, the post office time for something to be considered officially "lost" is 15 days, as far as I remember.

You may find that it magically arrives after all.

If you have the IMEI, do report it stolen after allowing enough time for them to think it over; 14 days from now?
If they ever activate it, it will be barred and no use to them, so at least they don't get anything for free.

Did you insure the shipment or require a signature at the other end? If not, shame on you.

You can't win such a case when you do not have recorded shipping or insurance. Sorry. And if the item weighed more than 13 ounces (in the US) it can't go first class. In the US when you print a shipping label thru Ebay the tracking number (recorded) is automatic.
