Iphone 5 from sprint is not working, can i get a new one?

I signed up with sprint on the 4 of april 2013. I'm not able to use the internet at all on the phone unless i'm using Wi-Fi at home and even then its a lil slow. The battery runs out very quickly. My boyfriend has the iphone 5 but he bought it at the retail price from walmart and it works good. He has way more apps than me on his phone but the battery doesn't run out so quicky. Another thing that is bothering me is when I bought it at radio shack the guy set the phone up for me which i thought it was very nice of him but now i'm thinking maybe this is not a brand new phone. I shouldn't be having so many problems with it, right? Or is Sprint really that bad. The guy at sprint said I had 14 days to exchange it for another phone. But what about getting a brand new iphone.

Better rush to the shop you bought and inform about the problem. I think they will solve it or replace new one.

I work at a radioshack and we only sell new phone, at least the one I'm at. It could be that you are just not in a coverage area for sprint. That may also be the cause of the battery drain as well. The phone will burn through the battery trying to look for a signal. You can look on sprints website to check their coverage. Or a radioshack rep can do this as well. If the signal is the problem, you do have 14 days starting with the day you purchased the phone to cancel your contract. If the coverage is not your issue, then radioshack should be able to swap out the phone, as long as it is in good condition, or you could take it to an apple store to to have them look at it.
