Maybe thats why the update is not being DL because Apple have seen you have broken the agreement between them and you when you originally set up the phone

Because it is jailbreaked you won't be able to update your Iphone you can try to unjailbreak it but that may not do it.

It should show an update. Perhaps a Cydia tweak is disabling the update checker (because seeing a (1) on the Settings app can be annoying)?
