Selling a fake iphone case but not advertising the brand illegal?
My friend had made a purchase of over 100 fake top brand(leave the brand out for now) Iphone cases for a very cheap price and sold them cheaply thru eBay. Ebay quickly took his listing as he was actually advertising the brand in his listing. After much frustration he gave up on the cases and gave them to me. Is it legal to sell these cases without mentioning the brand at all? Simply selling non brand Iphone cases isn't illegal right?
If they were made to be confused with another brand name by someone not licensed to make them and you knowingly sell them, it doesn't matter if you advertise the name or not. It is still dealing counterfeit merchandise.
China sells unbranded items in the US everyday.
You can sell them but if its saying something like "Appel" instead of "Apple" and has their logo, then no its not legal. It has to be clear that its not imitating a name or logo. Otherwise yeah you can sell them.
