Using an iPhone 4S that was found?

My mom works at a restaurant and she found an iPhone 4S on the floor. She took it home and contacted the owner's relative to notify them about the lost phone. The owner came in contact with my mom and told her that they would come pick it up. My mom waited and waited and the owner never came to pick it up.

I don't have a phone, so my mom thought of giving me the phone since the owner never came to pick it up. If she does give me the phone, could me or my mom get into any legal problems?
