Can i get arrested for miss-selling things on ebay?
Basically i put my iphone and ps4 up for sale on ebay, phone starting at 100 and ps4 starting at 300, i was just going to see if anyone would actually bid on them. I then realized that it had 2 days left before the auction ended. And i wasn't planning on selling them. But ebay said that i couldn't end the auction because someone bidded on the items. They both ended and i messaged the winning bidder NOT to pay for the item as i won't be selling or sending and they actually payed for both of the items. I then messaged them again saying i can't send the items as they weren't initially for sale and my phones cracked anyway and they haven't replied… Can i get in trouble for keeping the money if they haven't done anything about it? The moneys gone straight into my bank account…
Yes, it is a crime. And yes, you will get in trouble. Really big trouble. If you didn't want to sell it, you really shouldn't have put it on ebay. And even worse, you're going to pocket the money without giving them the product? Good job, that's a felony - theft, and fraud. Good job.
When you sign up for ebay and put an item (or multiple items, such as you) up for auction, you are in turn signing a legal document. Once the auction is over, and if someone had bid on this item, it is legally theirs. Cross your fingers that you also don't get sued for breach of contract.
What you did was scam someone of their money and what was supposed to be their property.
As part of putting it up for auction you agreed to sell it. And yes, keeping money is called stealing.
Well you have to wait till the buyer reply and send his money back. Don't be surprise when you get a bad feedback because you shouldn't even post it in the first place if you are not selling the item. If you want to see if people would bid on them Craigslist would have been a better site to try. You can just tell the buyer you change your mind. Ebay is more serious as in if people buy your stuff or win a bid you are suppose to sell the item. On Craigslist you can always change your mind just tell the buyer. If you keep the money without sending them the item then its a crime. Just refund the buyer As soon as possible.
Georgia as soon as you got the money you should have refunded it straight away not drawing it out and putting it in your bank account. Doing that indicates a fraudulent transaction. Any one investigating this matter would say if you did not intend to sell the items why did you take the money out of your paypal account and put it in your own bank account? You can't keep the money that was sent in payment for good you put up for sale unless you actually send the goods. Of course as soon as they received them they would immediately open a paypal dispute for "items not as described" and ebay would order you to repay the money within 3 days.
You are not allowed to have an ebay account if you are under 18, it sounds to me like you are definitely under 18!

Put the money back in you Paypal account, when the item isn't shipped the buyer will open a dispute and the money will be refunded. I'm not sure if there's another way of contacting them or cancelling the sale now.

Long story short the police managed to confiscate the iPhone and gave it to her before he was arrested. She now wants to give the phone to her other son, and doubts her arrested son will comply with giving her the passcode.
