Can this be used against me?

My ex had my kids Ipod Touch with him for the weekend. Somehow, I was texting my friend and talking bad (calling them names, and blaming them for things) about my ex and her boyfriend. They were able to get my text message conversations from my Iphone from the Ipod touch. They must have changed the setting or got into my account. If this gets brought up in court, how should I proceed cause they downloaded it off my kids Ipod touch?

Added (1). What's crazy is I turned off any settings associated to my phone off.

Added (2). I didn't put the messages there. Somehow they must have downloaded it from his Ipod touch from my account. Or my phone was linked to the other Ipod touch somehow because these messages are from typing on my iphone. She once broke in my email account years ago, and the court found out and used it against her.

If you have it set up so your messages get backed up on iCloud on both devices to the same account then they will sync between the two devices and your ex will be able to see them.
I'm guessing that is exactly what happened. Why would you not have your own account? I believe what happened was they went in the settings and change the settings to allow my messages to come through.
