Can you buy another iPhone without the person it is under being there?

I'm currently under someone's name in a cell phone plan, and I will be living out of the state from the person for awhile. The question is, would I be able to buy a phone without them being there?

You could buy the phone, but not the plan. They take ID when you purchase a phone plan because you are required to sign a contract. The same thing applies for when you want to make any changes to your plan, although you can do that over the phone or online anyway.

If you mean buying the phone on their credit, no you will not be able to do that. You can get your own phone in your name. You can always get a prepaid phone or see if that phone can be switched to prepaid and you handle the payments.
