Can you return an apple product in store if you bought it in store?

On October 27 i bought an ipod touch 5g for 323.00 dollars. It is pass the 14 day return policy but apple has extended there refund due to the Holiday. The item is open and used, no visible damage. I need the money and i would get more if i returned it then resold it. I GOT THIS FROM THERE WEB SITE

Items purchased at the Apple Online Store that are received between October 27, 2012 and December 25, 2012, may be returned through January 7, 2013. It specifically states the online store.

your receipt won't cover the ipod unless it is in need of repairs.

you also won't be able to return it as it has been opened, unless the ipod is in need of repair or replacement
