Could i have my iPhone replaced?

So I bought this white iphone 4s off ebay right and at the time I didn't know what activation lock was and when I did find out I learned that I would have to contact the original owner or whoever still had their account attached to the phone. I tried for three days even searching over facebook for a "Hiley McCourt". No luck and as soon as I decided to just sell it over ebay myself I got a message that said "Replacement needed" I was wondering if I took it to a iphone store (with proof I bought it) would I be able to get another one? The 'replacement needed' error is not what you think it is. It is saying that because your activation can't be completed and basically the phone is mad and giving you options.

BUT the lock you talk about is the iPhone iCloud activation lock that's a security feature. Basically it's designed in case of theft/loss to prevent a new person from reactivating the device. ICloud activation is darn near impossible to overcome and when people have tried it's been with limited results. Odds are if you didn't buy it from her you bought a stolen phone. That means even if you can bypass iCloud the phone's IMEI is likely blacklisted. It'll never be turned on by another US carrier again. It's an iPod paperweight now.

And don't bother with Apple. One, the warranty is out, and two, they don't meddle in third party issues-ever. They don't care even with proof. Odds are the phone was stolen and they or the carrier don't get involved with legal issues. They sell new phones and don't care about old ones.
So you've got iCloud activation and probably a blacklisted serial number to deal with.

It's bad enough to buy a stolen phone, but selling a stolen phone to someone else just compounds your illegal acts.

That is the icloud activation lock. The seller forogt to sign out of there Apple ID in icloud. The only people that can override that is Apple. But you need to have proof you legally obtained it as the Apple rep will default to thinking you stole it and while they will not call the police they will refuse to help you.
