Finding and using a lost iPhone 5?
If I found an iPhone 5 & can't find the owner can I use the phone without getting in trouble? What if they reported it lost and just got a new phone? What should I do?
If its a GSM iphone 5… Your ok
if its a CDMA iphone 5… Don't attempt to flash it to your account!
I would wait for the owner to show to where you found it. Maybe even put up a sign and ask a question that only the owner would know. Wait a week or so and if no one reports that they lost it, give it to AT&T or which ever phone company the phones on and hopefully they'll get it to the right person. If you keep it, you'd might want to change the number and when you do, the phone company might think that you stole the phone.

I had the find my iPhone and was able to trace the phone at a Starbucks today but after that it has been ofline. What is the probability of finding my iPhone?
