Help in iPhone I bought on eBay please

I recently bought a iphone4, used off of eBay the description was as follows: iPhone for sale brilliant condition, just upgraded my contract… However it arrived today (I payed on the 22nd) and the screen has brown marks on each side I don't mean marks, it's damaged also the button doesn't seem to
Also work, I don't know what to do as I'm 18 and this is my first eBay buy other than a couple of Xbox games. I would like to keep the phone and repair it but I don't see why I should have to pay for the repairs, if necessary I'm
Willing to ship it back however the sellers info says no returns. Any advice? Thanks

Added (1). I have also noticed a partial refund, could someone explain this to me, could the buyer send me money to pay for the repairs? Also if i have to send it back could someone give me a few tips on postage?

You should complain on Ebay. If that doesn't do anything then you could try getting it repaired, although that could be difficult.

I had exactly the same happen to me with an I phone, contact eBay and explain it wasn't in the same condition as described and they will get your money back, second hand I phones on eBay are usually trouble. Hope this helps

The seller has to give you your money back by law if the hand set is dose not work or has problems with it. It dose not matter if the seller says no returns as eBay will take the matter to court if the hand set dose not work. You need to email the seller and eBay a phone off the phone and tell them step by step what's wrong with the hand set. Then if you don't get your money back eBay will email the seller.

Firstly I would speak to the seller to try and negotiate a partial refund if you would like to have the phone repaired yourself. If you explain your problem it is likely that they will be keen to protect their rating, and be helpful in order to do so.

If you bought the item from an individual the Sale of Goods Act says that the goods you get must be as they were described to you.

For example, something second-hand should not be described as new - if it is, the seller will be in breach of contract. If a seller takes your money, but then sends nothing they would again be in breach of contract.

Seeing as you are within 45 days of paying for your goods, if you decide that you want your money back and the seller isn't amenable, you can raise a complaint using Ebay Buyer Protection.

The Which? Consumer Rights website has some more indepth information on what to do if you've got a problem with something bought on eBay, and how to claim against Paypal to get your money back,
