Iphone lost and found

My iPhone5s was stolen a month ago.
I could find the details of person using my iPhone using FindmyiPhone.
The thief had sold the phone to a shop.
The shopkeeper somehow managed to hack into my iCloudaccount, turn off find my iPhone, and reset my phone.
I could get hold of the shopguy via police complaint and infbon FindmyiPhone.
Now that I have got my iPhone back, it's logged with unverified iCloud account of the shopguy. I can't remove it or reset my device.
I don't have contact with shopguy anymore and have 0 chance of asking his iCloud password to signout.

Maybe take it to an apple store?

My question is i recently lost my iphone 5 (t-mobile) and had already called insurance and am receiving my new iphone5 through insurance. T-mobile had told me that they have lock/blocked my lost phone. But recently my friend had found my phone and is mailing it to me but what i want to know is that will i be able to use both the iphones? Or is the one i lost really locked and unable to use?
