How to know my iPhone is jailbroken or not?

I have bought an iPhone 3gs (USED) from market. It's 3.1.3 iOS running on it. But now a days most apps wants iOS 4.0.
experts please tell me how to upgrade it for free

So it is Jailbroken already?
If not, and you just want to restore it and update it to the latest update, plug the iPhone into your computer/laptop, download and install iTunes if you haven't already. Let the iPhone sync, then update it.

Plug it in to your computer and update iTunes to latest and it will prompt you to update your iPhone to (I'm guessing 5.1.1) or something with 5. Click on "Download and Update" when it prompts you and let the firmware download and update, your should have the latest firmware update or somewhere close by.
