Husband mad at me is this fair?

I confiscated my husbands phone and said he isn't allowed to use it, he keeps checking it for updates from the hospital about his Dad's condition. He is always on it and I got tired of it. He said I have no right to do that, that I'm too controlling, and that I should give it back, this was right before dinner and I was fed up so I dropped his phone in the water, (I'm really mean when I'm hungry I know.) He took the battery out of my phone and said I can't have it back until I buy him a new iPhone. He had the newest model and I'd rather spend the money on a new purse, is this fair?

He said I should apologize but it's his fault. And he said he going to spend the night at the hospital now.
