I bought a new iPhone with Argos online but in the box, was an old model, used iPhone. What are my rights?
The box was correct and sealed (though the plastic wrapping was sealed with a clear plastic sticker that's still attached) but inside is what looks like a several model earlier iphone - used and scratched. Argos have refused to let me return it. After an investigation (I sent photos) they have demanded that I take it into a store - which I will do begrudgingly this week. But surely an online sale is governed by online rules? Such as the old distance selling laws?
At least one advisor I spoke to at Argos accused me of trying to wrangle them! The same one then tried to tell me that Apple would be at fault, not Argos! Which I find extraordinary. I did manage to speak to someone else who has gone as far as they can, basically - which is I will take the phone to the store. I even bought my last phone from Argos, which I still have! And have an Argos card that I've bought several items with over the years. None of which seems to matter very much to them.
I would like to know what my rights are pertaining to this exact situation. And what my best practise would be for talking to Argos about this - as they're being incredibly unhelpful. And this is £800 that I can't simply lose because some b****** stole from them.
If you used a credit card, dispute the transaction. If you used a debit card, call your bank and ask if you can dispute the transaction.
If you have renter's insurance or personal property insurance, call the supplier and see if it's covered.
Instead of booting off why not do as they have asked. Go to one of their stores explain your side of the story to someone in the flesh and give them the opportunity to solve the problem.
They must get literally dozens of chancers every day trying to pull a fast one with high value goods both in store and online. That is not what I'm claiming you have done, all I'm saying is give them a chance to sort the issue out for you.
