And when I get my new phone I will be switching to android and there's no way I'm going to pay or all that music again so is there anyway I can transfer the music over to my new phone?
Yea. If you paid for it, then you already own it. If you go into your iTunes library, you can just take all the songs from there and transfer them over to your Android. I don't own an Android, so I can't say exactly how to do it, but I know for a fact that it can be done, because songs in your iTunes are just files, and files can be moved, copied, deleted, etc.
Why would you download music to your iPhone if you didn't know how to save music FROM the iPhone?
You can probably try copytrans or sharepod - I've never used them or any other software because all of my music was saved to computer and copied to CD. I don't understand why so many iPhone or iPod owners insist on directly downloading when they don't know how to protect their music. It's not like iPhones are only seldom stolen, damaged, lost or need to be restored or - as in your case - simply replaced. WHat were you going to do then?
