I want to get an iPhone 5, but my contract isn't up?

I have an iPhone 4 right now and it's starting to act up really bad. When I'm listening to music, the volume fluctuates and it shuts down at completely random times. I'm also not receiving calls or text messages, even when I'm in an area with excellent service. There's also a massive chunk of "other" space clogging up the storage of my iPhone and I need to get one with a larger storage space for my large music library. I have restored my phone multiple times to attempt to solve issues, but nothing has changed. 16GB iPhone 5's are available for $200 with a contract, but my contract isn't up yet for my iPhone 4. I have been through a year with it. Can I still manage to get an iPhone 5 through AT&T?

Not without paying the full price. But try going to the Apple store or AT&T to see if they know what is going on. And if you have insurance you may possibly get a new one if they decide that it is broken.

You will need a fee, and buy it for contract price and even if you wait for contract to be up you would get the iPhone 4s

Check with at&t as sometimes they will let you upgrade with a new contract as long as you are close.
