IPhone 5s upgrade from iPhone 5?
Well I wasn't elidgable for an upgrade but I ordered an iphone 5s from apple.com for 489 I think it was with ATT for the new iphone 5s. It comes in tomorrow. I sold my iphone 5 on ebay for 400.
What will the contract situation be?
What do I tell them? It broke?

I don't know what you bought but the 5s is selling for $649 on the apple store and the 5c is selling for $549 both off contract. But whatever phone you did get, you can just put the old sim into the new phone. ATT doesn't care and will not send you anything and you don't have to tell them anything. As long as you keep paying your monthly bill you are fine. Even if you stopped paying it for some reason ATT would just charge you a cancellation fee as well as the remaining balance on the old phone.

I can't tell from the price you paid whether the 5S came with a contract or not.
If the new phone you bought comes with a contract, then you now have TWO contracts, which is a bad idea, so you should return the new phone as soon as you get it (I think you have at least a week or two, maybe 30 days to cancel the contract).
But if the new phone came without a contract, then as long as it's for the same carrier as your old iPhone, or it's unlocked, then you can just move the SIM from your old phone to your new one.
Don't report your old phone as lost or stolen because it might get blocked and that would be unfair to whoever you sold it to. The carrier won't care what happened to it as long as you keep paying your bill for the rest of your contract.
