Is it illegal to sell fake items?

I was going through Youtube for a few reviews on the new Studios I'm buying when I came across this guy.

This guy buys fake Beats by Dre not only for himself but to sell to other people under the pretense that they are real. He admits it on several of his unboxings. Is it illegal?

When people on eBay sell fake goods like fake iPhones, Beats, clothes, consoles, Tvs etc… Can they get in trouble?

Isn't this seller breaking some sort of copyright infringement rule?

It's fraud and that't illegal.

It's fraud but the police have better things to do than worry about some kid selling headphones, he will get in trouble eventually but don't expect it to be to quick

Yes it's illegal. It's called counterfeit goods. It's sought liken to counterfeit money. The people who pass it are not as responsible as the ones who print it. They still can be arrested for selling the goods. The issue is usually, these items are made for cheap in other countries and shipped to the US. People buy the items to sell and most know it's counterfeit. It's not easy to prove they know it and they usually claim they just placed an order for some items. The US Customs will seize these items and no one typically claims it.So, they end up with warehouses and then destroy the items. After that, it's up to local law enforcement to catch the people with items that got pass US Customs and sold on the streets, in stores and ebay. It's a cat and mouse game across the table. Customs are more interested in drugs and can't stop every counterfeit shipment and the police are interested on more serious offences than who sells counterfeit Iphone etc.

It's illegal to sell counterfeit items, period. They are not allowed on eBay -- you can look up their policies which explicitly state as such. Those listings get removed. It is *not* okay even if someone presents them as fakes. All counterfeits with counterfeit logos, etc., are illegal. They're usually going to be trademark issues.

The seller you link is in China, which is the source of most fakes these days. They're a pain to stop on the China end. I don't know what you think your local police are going to do to someone in China.

Anyway, if you see fakes, you can report them to whomever the original trademark owner is. They're the ones who'd need to pursue things anyway. And some companies are indeed very aggressive about shutting down any infringing activity. Others don't find it worth their hassle.

You are only stealing from the real deal that's fraud

It is illegal and the police do take action, as do trading standards in the UK, but they tend to do this in concert with the rights holder (the company that makes the real items). Companies selling high value branded goods have departments and legal teams who's only job is tracking people like this down. They then work with the police and ISPs to close the shop or ebay listing down, and sponsor private prosecutions to have the person's ill gotten gains seized / confiscated. Repeat offenders can be jailed too.
