Possession of a stolen iphone? - 1

I bought the iPhone from a kid in my class he was asking ppl if they were interested in buying it I took a look at the. Phone and asked him how much expecting a high number he told me 80 I didn't believe him but told him if have the money in 2 periods so I call my mom to bring 80 and she does I meet with him later at my locker and he gives me the phone for 80 it was an iPhone 4s and I thought that I just got an amazing deal anyways 2 periods after I'm called to the main office I explain the situation they tell me they are aware that I didn't steal it because turns out the kid I bought it from had stolen another one and was caught with it and my 80 $ which they. Took from him and gave back to me but the people of the phone I had are really pissed and filed charges against me I'm 16 and have never had any problems with police before the guy that actually stole it was caught with a diffre t iPhone but the ppl that owened it didn't want to press charges on a kid so know ithe cops came to my house and explained to me that I'm under arrest but not actual hand cuffs (I get to stay home) and that they know that I didn't steal it and want me to give a state ment that I bought the phone from the other kid but I have to go to court in a month (right on exams) and get fingerprinted! And pictured and stuff. Anyway they told me that they know that other kid stole it and told me that they want to arrest him not me because he has been in trouble with police before. The 2 other kids at my table don't want to give statements that they saw the kid with the iPhone selling it to me because the kid will find out its then who told on him if they did give statemnts that charges would pass from me to him and they told me it would be like it never happened and know I'm screwed over a stupid mistake I would like to know what will happen in court I'm only 16 I'm live in new York state I'm really stressed over it. The cops told me the phone is valued at 600 its a 4s 16gb please help me:/

Have the kids who witnessed it give anonymous testimony. The police will allow it. Have your mom talk to their parents and see if they would be open to their kids writing a witness report. That way they wouln't have to take the stand if it even comes to that, which it probably won't.

If the kids who give the testimony start telling people at school they did it, then it's their own fault if their names get out there, not yours.

You're only 16, never been in trouble before, right? You are not going to get in trouble over this. You acted in good faith. You had a verbal agreement. They can't send you to Juvy, jail, or expel you.So… Don't get all worked up over nothing. It will pass.

Stupid is as stupid does. You can't expect to buy an Iphone for 80 bucks, at school or anywhere, sorry. Your mother is just as stupid for giving you the money.

You're looking at a possession of stolen property charge you knew the deal was too good to be true and it was, nobody is going to sell a $600 phone for $80 unless it is broken or stolen. It doesn't matter if you bought the phone in good faith it was stolen and you were in possession. In most states involving a possession of stolen property charge the burden to prove criminal intent is not stringent and in many states it is nonexistent. BTW you shouldn't have listened to the cops they are allowed to lie to get a conviction the statement you bought the phone may be all they need to get a conviction. If the cops really didn't want to arrest you they wouldn't have and you wouldn't be going to court.

WRONG the fact he sold you the phone isn't in dispute the charges wouldn't pass to him you still bought a stolen phone and all your friends would be doing is putting the final nail in your coffin. Like I said cops are allow to lie to you and they are, you should have lawyered up before you made a statement.
