Sold a phone on CL. Man can't unlock it wants a refund
So I sold an iphone over CL. When the buyer contacted me I stated the phone carrier was AT&T. He wanted to switch companies. I told him it want unlocked but I'm sure he can have it unlocked. He stated that was fine and we completed the transaction. Later that evening I get a call from metro pcs stating I have to call AT&T for the unlock code. Well upon calling AT&T I find out you unlock the device through iTunes. I explained it to the man who bought the phone but he is insisting on a code, which I obviously can't give him. Now he says he wants a refund. My question is, is he entitled to a refund even tho I told him the phone was carrier locked and he knew there was a slight possibility it couldn't be unlocked? I never lied to him. The phone can be unlocked but he is refusing to do it the way I told him he needs to do it.
From what you told us, you stated that the phone would be easily unlocked, if desired.
This is not the case. You sold the device u Der false premises and that's illegal.
Well, since you did tell him you couldn't unlock it, I think it is his fault also, for him to not listen to you he probably just wants his money back so he don't have to do any work. However, please try to work it out an tell him all this stuff so he won't make it a court problem.
When you use iTunes to unlock the phone, it has to be done from the previous owners account - so even though he now has the phone it's you who can unlock it still - remotely!
Ohh, that's a bit tricky It will depend on the payment. I know companies like paypal will side with the buyer, and therefore, most likely force you to take it back and give him a refund. Now, if you have proof (like an email or something) that can prove that you told him that info, how the phone couldn't be unlocked, and that he said it was fine and still bought it, well, you might have another case then.
If you do have an email or proof, just send it to him saying that he accepted the terms when you sold it too him. Or you can just tell him to pay for shipping back to you and then give him a refund. And try again on a better site like ebay. Craigslist is nice cause it doesn't have fees and what not, but i feel like ebay might be better in terms of buyers.
If you sold the phone more then 500 dollars its by law you have to have a written contract and pretty sure if he will agree to him knowing about the lock situation it coukd be settled as a verbal contract if under 500 but if he claims didn't know might be problem always get some proof when you sell something make sure you do what big companies do free bed across acreen but very tiny writing on bottom of screen explaining how the bed is actually 900 dollars do what is always best for you never feel sorry for someone and don't be nice because in the end people will get you and its simple
