Taking photos of photos = copyright infringement?

I want to post multiple images of movies, tv shows, and youtube videos to my instagram. The images are of repetitive graphic themes that I find within the various media types. For instance: the "oh sh*t!" face on multiple characters from multiple movies. These images would be pictures that I took with my iphone- they would not be screen grabs or anything other than me aiming my camera's phone at a portion of the paused movie or tv show on my computer screen. Am at I major risk of copyright infringement if I post these to my instagram?

Yes. That would be copyright infringement. Just like copying pages from a book.

Yes, it's copyright infringement. You don't get to make and distribute copies of others' works without permission. Though your use might potentially be transformative in nature (and thus legal), you can still find yourself in court trying to use that as a defense. Copyright holders won't readily back down, nor should they.

Taking a photo of a photo is a classic form of "reproduction", or "derivative work", both of which are the exclusive right of the copyright owners, subject to statutory limitations on their rights (e.g., fair use, classroom use, etc). You would have the burden of proving your use qualifies under one or more exemptions unless you have a license for each and every image you reproduce.

The fact you will have "posted" the images also compromises the copyright owners' exclusive right of distribution, and it the event most likely to trigger any sort of action. They may ignore you or simply ask the web host to remove the infringing files immediately, or sue you for up to $150,000 for each image.

Professionals would rather pay a few bucks for a license, or possibly obtain a "courtesy license" for free, rather than face a million dollars in lawsuits.
