Erase back to factory settings to remove all of your information. State whether it's locked or unlocked still to ATT. Remove your SIM card. That's about it. Best luck.
Restore it through iTunes. That's about it. Activation Lock wouldn't be a concern since that is a feature of iOS 7 & up running devices.
Oh & there's no "iPhone 3". 3G or 3GS.
