Who will win this case on ebay seller or the buyer?
Basically I sold an iphone to a buyer in fully working order and after 22 days of use the buyer opened a case without even contacting me to return the phone back as not being described. The fault was that it was not picking signal and buyer said, it was kept in fridge to in order to gain signal which I do not recommend for a mobile phone. Shouldn't the buyer have contacted me before trying out those methods then buyer replies to case that it was not kept in the fridge it was only held in a cold environment in order to gain phone signal and bring back the normal temperature of phone because it was overheating which I did not have when I had it. I just want someone to help me out if I should get the phone back being damaged and give the money back?
Personally after 22 days I don't think he should get a refund. I'm not sure how that works on ebay but 22 days of use its theirs at that point, if they wanted a refund it should have been within a few days.
Depends on the sellers return policy. But given he didn't take it up with you first usually means that ebay will side with you but the entire description from his side is very fishy. Seeing as heat doesn't affect a cell signal. And assuming u described it as used its his fault for not determining it would work on his network. Its more likely hes just trying to get his money back since it won't work with his carrier. Any communication you do now should be through the resolution center so eBay has records of it
It isn't considered normal use or practice to place any mobile phone in a fridge… If you have a copy of any communication that suggests the purchaser tried this then it will help your case… Nobody can say who would win… That is down to whoever is 'judging' the case… And has all the facts in front of them.
Copy and paste all corespondance into the response box to ebay, plus length of time they took to complain from receiving item and complaint, also they should have got in contact with you first.
Ebay customer service is rubbish, there's no way of telling who wins, but if what you say is true it looks like you have a very good case. You always take a chance with used electrics, if it works when it arrives then you should take the fall if it goes wrong later.
if you feel very strongly about it then stick to your guns and insist that the buyer should have complained immediately, or at least within a reasonable time period, like one week.
If you are a regular seller you might want to think about making your returns policy clearer in the listing.
