I don't want to refund a buyer on ebay?

I sold an iPhone and clearly stated no returns. In the description i did not say the iPhone was unlocked to all networks and they are now complaining because they say it was falsely advertised. I know i should have explained this buy other ebay members asked this question before bidding, i do not think this is an example of false advertising. They are demanding a refund and are threatening to report me to ebay if i refuse, however with the money they paid i have already paid the 10% to ebay, listing fees and paypal fees to transfer to my bank account which amounted to £20+. If i do end up having to refund the money can i get this back?

This "no returns" statement is illegal under the distance selling regulations, so you shouldn't say this… If an item is not as described you do need to refund, also the buyer has 14 days in which to return the item for a full refund, you can't just refuse because the buyer didn't ask a question. You need to resolve this, you won't get a refund of fees as you have used eBay's services.

I'm sorry Lilly, but you are wrong. Company trading on ebay can't sell stuff stating "no returns" - this is covered by distant selling regulations. Person selling on ebay may voluntarily "opt in" to accept returns but not obliged to do so meaning nothing prevents me as a person to say "no returns" in my listings on ebay.

Back to question - in detailed item description on the top of your listing was it stated that phone is locked to a specific network? If not, you have a problem. Give us listing number

The simple question is "was it listed as locked or unlocked"?
The fact that you admit that you should have explain that is already an admission of guilt (mistake)

When selling a phone, that is one of the important feature of the phone that needs to be disclosed.

When sellers makes a mistake, even unintentionally not providing important information, they take the loss.
Ask them to return the item and proceed with the refund, to minimize your loss, and to receive credits on your fees.

If you don't cooperate, EBay will refund their money, even without returning your item, and they will collect this from you. Then you are out of the phone and the money.

Regarding returns or no returns, it is always allowed by EBay if item/s is not as described, if the seller opt out, it doesn't matter, EBay will refund the buyer, and the seller will loose their item and their money.

As a private seller your 'No Returns' is meaningless if the item is not as described or information that would be expected for the type of item was omitted. If the buyer opens a case and you have to make a refund your 10% final value fee would be returned as the sale was effectively voided by the refund. Incidentally, ebay almost always favour the buyer.
