I got a ticket for watching a video while driving. Would I win if I disputed it?

I was watching a YouTube video while I had my iPhone attached to the top of my steering wheel by Velcro. The cop pulled me over and gave me a ticket for "texting while driving," even though I wasn't actually texting, nor did he accuse me of that. He wrote "As I passed the driver I saw him watching a video on his phone as he held it on his steering wheel. He stated he didn't think it was distracting." He is wrong when he said I "held" it b/c it was attached by Velcro, and my 2 hand stayed on the wheel. He then stated it's illegal to use web-based applications while driving. This was in Gwinnett County, Georgia. Do you know of any valid arguments I could make to win? Otherwise I'll just pay the ticket and make sure it doesn't happen again. Polite answers only, and please don't switch the subject insulting me for this. I've learned.

I doubt your local laws would allow what you were doing.

Sometimes the police get their accusations off. All that happens when you then protest your innocence is you admit to doing something else wrong. In other words, you can go in there explaining how you weren't "holding" it and there was velcro. What other word do you think he should use? It was being "held" by velcro. Close enough. Insignificant technicality. No, you're not winning any dispute.

Except for noticing the police car that was passing close enough for the cop to see what I was doing.

Pay the ticket. The last thing you want to do is walk into the court room on your high horse saying that you weren't texted but instead you premeditatedly distracted yourself while driving. I you contest the ticket there's a chance the judge talks points of your license. Your court case becomes public information and your work could see it. I doubt you will get the judge to rule in your favor and the judge could actually make it worse.

You would lose big if you tried to go to court. What if you watching that movie distracted you enough to cause an accident? What if somebody died?

Tell the judge you were not texting, you were watching a video on You Tube. If he believes you, he might decide not to make you pay the fine because, the charges are for texting.

Shut up and pay. Count yourself lucky, too.

I would NOT put this in front of a judge… I can't even see a jury trial go in your favor for this… I think you are lucky the officer didn't cite for reckless driving. Pay the ticket with a smile cause it probably should have been worse. You must gave been really cool or polite to the cop.

Nope. Might as well pay the ticket. Using your electronic device while driving is illegal in multiple countries.

I don't think you are going to get out of it. Reading up on Georgia's law, it seems that Gwinnett county is leading the charge in enforcement and convictions. While the law bans texting, it also bans manipulating your cellphone. If you are downloading data, you are violating the law. Watching a video while driving violates the law. Texting and driving is dangerous enough. Watching a video is a complete check out from safe operation of a moving vehicle. The judge is NOT going to be sympathetic!
