Iphone 5c faulty after warranty - EE Vs APPLE, who's responsibility is it to replace it?

I bought the iphone 5c November 2013. It was replaced last year April. Now this one has packed up and isn't working properly. Because it has been over a year, apple said that it is a known fault with this model but because it is out of warranty, EE have to change it. I should explain that its consumers law. EE are saying I should go through insurance as that's all they can do for me. But it will cost me £50. Consumers law sates i have the right to cancel my contract and get full refund but other law state otherwise. Where do i stand? What should i do next?

Grab a copy of the EU leaflet below and show them the section on "Product Guarantees" - specifically the text on the right side of that page:

The law changed back in 2008 to make sellers responsible for two years, but most still try and pretend it's only one year. (Other brag of a Free! Two year warranty, as if they are giving something for nothing rather than just complying with the law.)

The legal reference is "Directive 1999/44/EC"

You can also remind them that items they sell must be "Fit for purpose" and "Of merchantable quality" for six years, under the basic UK SoG Act rules. Threaten them with Trading Standards if the still try to weasel out of it.
