Is this copyrighting or is this allowed?

There's a cool and fairly new company selling phone cases that have Rolex (The Crown) and Audemars Piguet (The AP) logos and font on them. Is this illegal and copyrighted? Or have they very slightly edited the logos and font so it doesn't make them copyrighted? Thanks very much!

Not copyright, but it might be a trademark infringement. However, if you bought one, you would not be in trouble - It's would the company producing these that would be in trouble, and if found to be infringing, pay a royalty and/or license to those they stole the trademark from.

But for all you know, they might already have a license deal in place to use the logos. It's not really your place to sue them over it. You have no damages in this case either way. All you can do is decide to purchase one of their products or don't purchase it.

If they are openly selling them, they likely have permission.

The design may be covered simultaneously by copyright and trademark laws. Unless they have the necessary licenses, anything "confusingly similar" or "derivative works" would be infringing the rights of the original owners. Check with the brand owners to see if they have, in fact, licensed their properties for use in this manner.

The site is located and owned in the USA (I know because I just did a "whois" check - Something you should know how to do, or simply stop using the internet until you do). The server is not one that caters to the underworld. The site has a valid SSL cert (most underworld sites do not). The site is not registered with a shady service like GoDaddy.

The logos are parodies. If you look at them you will notice that they are making fun of the perspective brands. Under USA, and international trademark laws they are legal.

There was a company in the USA called "Big Dogs Sportsware". They printed T-Shirts with lots of parodies.

  • Would this iphone lens be allowed in no-cam concerts?
