Stolen iPhone still traceable?

I'm buying a second hand iPhone. It has been disabled, but he says that it was because someone changed his passcode and forgot what it was. What I want to know is; if it is stolen can I get in trouble for having it? I would be doing a full restore and all that, but even with everything completely wiped and a new sim, is it traceable?

Why give yourself all the aggravation. Its quite possibly disabled and you can't restore it without knowing the original password. Give this one a miss

Traceable? Yeah. If 'find my iphone' gets a Wi-Fi signal and the owner happens to be using it, that's possible. But your missing a big point. You can bypass a forgotten passcode, but if the owner's old iCloud account is still on there, and you have zero clue of that password, there's virtually no way to bypass that to activate the phone--even as an iPod. ICloud works as a security feature too and a lot of people don't know that. So even if the owner has given up looking, if the security lock is working, it's now a paperweight and worthless. Yes it can be traced. Someone i know recently was trying to enable the service that allows locating an iPhone, when they logged in to register the new device, they realized the old iPhone which had been sold was still being tracked by the same credentials.

You won't be able to even wipe it if the owner didn't wipe it because of the password. You also won't be able to turn off find my iphone.

The phone looks to be in perfect condition, but the guy doesn't know any information about it.
