You can go to the police and make out a theft report. THAT comes before any lawsuit.

You'll get millions, I'm sure a jury will award you millions in damages.

Yes you can.

… I'm a retired police officer. I retired as a sergeant, after 29 years, from a very large department, about 12,000 officers. I was a patrol officer for 4 years in a very diverse area. I was a tactical officer in the high rise project areas of my city. We called it vertical patrol in that we walked the the stairways of the high rises most of the time. I did that for 5 years and was promoted by test to detective. I worked violent crime (homicide, sex, officer involved shootings, robbery, kidnapping, serious non property incidents) for 11 years until I was promoted to sergeant. I worked as a street supervisor, a bicycle patrol supervisor and a desk sergeant/watch commander.
During my time as a tactical officer and a detective I was a unit representative for the police union.
I have a B.A in English and an M.S. In Law Enforcement Administration…

This no makes sense.

You can report it stolen and have it shut off.

A lawsuit takes a long time. Report them for stealing it. The police will get it back.

You can try or you can tell them if they don't return it you will be talking to the police about it

Report it stolen to both the police and Apple.

No, but you can report them to the police.

It partially can matter why they have it in the first place.

If they took it without permission, you can report it as stolen.

If you gave it to them and they're not returning it, the police likely won't touch it. You can file a replevin action to force them to return it. Alternately, you can file a small claims case for financial damages. In the meantime, if it's on your cell plan you can tell your cell company to deactivate it.
