You can upgrade at any time. Previously, when contracts were offered, you could upgrade at any time but you could get a good deal when your contract was up for renewal because they offered a subsidy if you renewed your contract. If you upgraded any other time, you had dto pay full price for the phone.

T-Mobile no longer offers contracts and subsidies, YOu can upgrade at any time, but will have to pay full price for the phone. Since you are currently under contract, you have to fulfill that contract before you are released from it- but you can still upgrade at any time.

My suggestion is to pay the early upgrade fee penalty. Sell your current phone you have now and use the iPhone 5 when it comes out in mid April.

Lots of people buy used phones on eBay. I do it a lot. You could probably sell it for around $300 if your phone is new so it washes out your penalty.
