Can Apple TRACK down a stolen iphone?
If the phone is BRAND NEW (UNOPENED). CAN THEY TRACK YOU UPON ACTIVATION OF TOUR IPHONE?

Yes. All phones can be tracked as soon as they are turned on, since the first thing they do is contact the nearest cell network and identify themselves.

If it has not been activated yet, they won't have the serial ID in the computer system. That is entered during registration. Once registered, it can be locked and tracked, but not when it is new in the box. They can search their records for the numbers if you don't have them, but they can't put it on the police report for you. You would need to do that.
If purchased through a phone store, it is a different story as it is already partially registered as their inventory, (they actually bought it from Apple) and they could put it on their blacklist, which may or may not put it on other phone provider systems.
That is why it is so important to register it immediately so that the info is automatically available to all phone companies, Apple and police. Ordering anything of value should never be done to an address where there's not someone to receive it.
