Can I file a civil suit for theft?

I had a phone stolen from me in Tennessee, and they arrested them as a felony (over $1,000). Mean while the phone had been in evidence so I had to buy a new one and my iPhone X has dropped in value. Can I sue for the cost of my new phone and depreciation of the last and maybe more?

Troll. But it's a good story. I enjoyed it.

No, you don't get to sue for the phone plus the new phone plus a new car. You can sue for the value of the phone he stole. Used phones aren't worth a lot.

Some states have a victim compensation. That makes paying you back part of his probation.

You can sue, but thieves never pay up, so your wasting your time.

You could try, but do you really think that it's worth the effort? Theses guys are thieves, so they probably are broke.

Yes. You can sue for any reason. The question becomes… Can you win? Yes, you can win because the thief deprived you. Can you collect? Does the thief have money? Maybe you can garnish his pay from his next ten robberies?

Yes for theft but not for depreciation. Don't get greedy. Thieves don't control the market value of economics

Yes, you can sue.
In general, your legal damages are limited to the value of the phone that was stolen as of the day it was stolen.
You MAY be able to make a case for the cost of replacement with a phone of the same model as the one stolen.
Technically, you would be arguing that the actual value of the stolen phone was what you had to pay for a replacement.

Can you sue? Can you win anything? Only the old phone's loss in value. You would have bought a new phone at some time anyway, so no recovery. You could have gotten a secondhand phone cheaper. Now you can sell your old phone. But since it lost some value, you should probably recoup that. Anything else is unlikely. By the way, you have to sue the phone thief. You can't sue the police over this.

You have to wait until the guy is "convicted". Then you can sue.

  • How to insure my belongings in the event of theft internationally? I've taken a look at some traveler's insurance, but none of the policies seem to do exactly what I want. I have been robbed multiple times while abroad and obviously it's always a pretty big financial burden. I'm going to be in Mexico City in a few weeks and will be staying in a pretty cheap hotel with a laptop, iPad, iPhone, passport etc. Is there any way to financially protect myself in case any of that gets stolen?
