Can I go to a small claims court over an iPhone 5 screen?

Basically my ex- friends child got hold of my phone and dropped it on the floor and shattered my screen, she was really apologetic and said she will pay for my phone, I text her and asked when she would do it and is now refusing to pay when she had said she would, I don't have the money to pay for it but yet she lives at home with her parents etc just wondering if I could have a bit of advice?

It's good that you said "ex-friend", because after you haul her but into court to make her pay for a new cell phone, she definitely won't be a friend any more.

Not everything in life is a lawsuit. Go buy a cheap phone.

Yes - you can take anyone to Small Claims Court any time. The only restrictions are jurisdiction, dollar amount, considerations of that nature.

You would have to sue the parent for negligent supervision - and I'm not sure you would win.

This is where having insurance for the phone comes in handy.

A replacement screen is not expensive and you are friends.
You can replace it by yourself now.
In the future, your friend will pay you or do other things for compensation,
maybe a drink or dinner.

By the way, if you have a newest Premium Tempered glass screen protector,
the screen will not so easy to damage.
