Can this be used against me in court?
So IIm being accused of stealing someone's credit card and purchasing an iPhone. If I ask that s said person to drop charges and allow me to pay the value of the phone can and will that be used against me in court?
One assumes you are guilty of finding a credit card and using it which is stealing. If the victim drops the charges you will have no case to answer so, even if he does not agree your proposal, you can't be worse than guilty which you are.
Yes it can. The victim can't drop the charges, only the DA can. Also keep in mind that since the issuing bank of a stolen credit card normally reverses the charges for the card holder, the card holder is not the victim, the issuing bank is.
Yes, and I hope they throw the book at you. I detest thieves. I don't know where you are but I hope it is Saudi Arabia. Do you know what they do to thieves there? I'd love to see you trying to use an iPhone with no hands.
Yes.
Yes, the victim can't do anything to drop charges. Only the DA can do that, and even if you pay back the person it doesn't change the fact that you use another person's credit card and therefore committed fraud. This is a federal crime, the government is the one who presses charges not the individual whose card was used
Yes. Furthermore, the DA does not need anyone's permission to prosecute you.
- What will these situations be charged as in court in the state of CA? 1) someone is jogging though a park and is approached by a gang of six to ten people who began taunting the guy and start punching him and gives him a black eye in the process finally they steal his iPhone and take off running 2) steal someone's stuffed animal and then beat that person up then run off 3) kick someone on the side of their head the person struggles to get up but is kicked in the head again finally you demand that persons money steal his iPod and takeoff running
- What will be charged against me in court for a stolen iPhone 4? So, I recently got caught up in this mess, and got arrested for stealing an iPhone 4… They haven't given me a court date yet. What can be charged against me? First offense ever, still a minor, confessed to stealing it.
- Should I Continue Reading The Batman: Court of Owls Story Arc? I'm new to the batman comics and have started using the DC Comics iPhone app and have bought three issues of this Batman arc. I kind of like it but wanted to know if there's a better Batman arc to read that is on the app that includes a more widely known character and Batmans problems with character over a fairly large span (The Joker, Bane, Ra's Al Ghul, Scarecrow, Two Face, Mr. Freeze… )
