Can I sell my iPhone that's still under contract?

I want to get rid of my iPhone 4S (still has 7month left for contract) and get an iPhone 5 from eBay. Would I be able to sell my phone if the contract is still on? And if so, how can I make sure all the data on my phone transfers to the new phone I'm planning on getting before I sell it?

Yes you can.
I bought a phone from a carrier and sold it 2 months later… Your contract is based on you cell phone number… So carrier has nothing to do with your phone.
And what would you need to transfer? Contacts? Well just copy them to your sim and thats it.
All the music, pics etc can be re-synced on your new iphone.
