Can i sue the person who stole my iphone from my backpack?

Well this actually happened on Thursday this kid stole my phone from my backpack and their was an investigation is school then, my friend over heard this kid names Danny saying "dude look here I stole tanias phone do you want to buy it off" well then she Texted my friend grecia bc she didn't have my number saying I saw tanias phone grecia then told her teachers who told the VP when the VP got the student during lunch Danny told him I did steal the phone but I handed it to someone else to hold it we asked where it might be he wouldn't say even when we said you won't get in trouble and youll get 50$ for "finding"it and not have to pay the 90$ he spent on iTunes he wouldn't cooperate. So I was wondering can I sue him to buy me a new iPhone or make like a judge make him give me back, pay the 90$ of iTunes money is so how much for a lawyer I have like 10, 000 that is supposed to be used for my sweet 15 but I rather have my phone back bc it has baby pictures I had the only ones left bc our house was robbed and they took our cameras, laptops.camcorders, etc

Ps, hes like 13 or 14 and has a history of stealing and I'm 14 but I don't care he had so many chances to give it back so this is plan B

You will definitely lose money in the process. Even in small claims court.

I would punch the *** out of him! You're a girl.go ahead and kick his scrawny ***

You can sue anyone you want, it's all a matter of if you can win.
There's also the matter of being able to pay the court fees.

When you look at the cost of court fees vs. How much the phone is worth it's really not worth it. You're the one who left your possessions unattended, it's your own fault and all you can do is learn your lesson.

No.

You can file a police report.

I *** hate you and your generation.

First of all, have you tried to use the Find My iPhone app? It will aid in your recovering your phone.

Second of all, and this should have already been done- have you filed a police report? And if he confessed to the VP that he took it then make sure the police talk to the VP as well.

You absolutely CAN take him to small claims court (you do not need a lawyer, and you can ask that he have to pay the court costs (which are not much). He will have to return your property and/or replace it along with paying the costs he incurred.
