Well, iPhone 4S and iPhone 5 all come with Siri pre downloaded. The iPhone 4 doesn't but there are a lot of jailbreaking techniques that can get Siri on any Apple product… Even the first generation iPod Touch… Even though that won't be useful because the first generation iPod Touch does not come with a microphone pre installed but I hope this answers your question. If you want Siri, go with the iPhone 4S or iPhone 5.
No. Siri is only partly implement on the device. Much of the Siri function is on Apple servers. Siri could work on onldwr phones, but the servers will only take requests from 4S (and now 5.)
