Could I get arrested for unlocking?

I was given a iPhone 4S and I want to know if I could be arrested for jailbreaking it and then unlocking it.

It is a 5 year felony in the US Although I doubt it is prosecuted very much. It isn't illegal to jailbreak.

The best way would be to contact the current carrier, explain the situation and have them send off the unlock code.
