To set your expectations right, I want to let you know that once you escalated the case we may ask your buyer in exchange of a full refund or may issue them a partial refund without the item being return to you.

They are only warning you that you might not win.
If the deal included delivery, you are responsible for any damage in transit (assuming you didn't insure it)
Tell the buyer that if she returns the phone, you will refund all her money.
If she doesn't return the phone, eBay may refund her money but you will sue her for the full amount.

They are saying they might side with her and you won't get your phone back
Tell her to send the phone back and you will refund her IF it is returned in the same condition which you sent it and with all accessories
Ebay almost always sides with the buyer so take the phone back and sell to someone else

The other two are right in that Ebay most of the time side with the buyer.

Tell her you want the item back, via trackable post as per Ebay's rules, and when you get it back, you will refund minus postage costs, as per Ebay's rules.

If she doesn't send it back, then if you have the IMEI code, get it locked so she can't use the phone herself.

A friend sold a phone and the buyer said that the phone didn't work and refused to send the phone back. When Ebay refunded their money, my friend actually locked the phone with the IMEI code. They then left feedback stating that the phone stopped working - she was delighted and put in her reply that they said the phone didn't work and therefore Ebay gave them a refund and that knowing the phone was working, she locked the phone.

If you don't have the code, threaten to activate it - you never know - calling her bluff may work but next time, make sure you have the IMEI number so if this happens again you can block the phone.
