Got a free iphone is this illegal?

Bought a iphone 6 off Ebay for $350. Seller lied to me and it turns out the phone dies at 40 percent battery because it has a bad battery. He refused to take it back or give me half my money back. After i opened a ebay case i won. He refunded me. He also has 2 negative feedback of people calling him a theif/scammer. After he refunded me ebay emailed me saying to not send him the phone back because he is refusing to pay for a "return shipping label" he wants me to spend $15.00 from my pocket to ship it back to him. Ebay told me i should not have to pay anything to ship it and since he is not listening i can keep the phone. He keeps messaging me on ebaying saying "give me my phone back" can i get in trouble? What should i do? Ebay said to keep it. Should i just block him?

Once eBay refunds you from his account, he can't longer send a return shipping label but, once they refund him, the case is closed anyway. He had his chance to be honest. He gave that up. Legally, you have to return the phone, you did not pay for it. That said, he'll have to sue you to get it back.
